First Month Free Promotion Terms and Conditions

By accessing or enrolling in a Promotion (as defined below) or clicking “Submit,” “I Agree,” “I Accept,” “I conform,” or anything similar, checking the box presented in proximity to these Promotion Terms and Conditions (these “Terms”) or by otherwise affirmatively manifesting your assent to these Terms, you signify that you have read, understood, and agree to be bound by these Terms and Electricity Sales Agreement.
These Terms do not limit the Electricity Sales Agreement and are in addition thereto, and these Terms are hereby incorporated by reference into the Electricity Sales Agreement, with any proviso that references to “this Agreement” being understood to include these Terms. In the event of a conflict between the Electricity Sales Agreement and these Terms, these Terms will control as to the Promotion. Unless otherwise expressly defined below, the capitalized terms used herein have the meaning assigned to them in the Electricity Sales Agreement.
These Terms commonly apply to all promotions offered by Inspire Energy Holdings, LLC (“Inspire”), including any that you may access through a promotional code (a “Promotion”). If Inspire offers you a Promotion, additional terms of the promotion may be disclosed to you during your sign-up or in other materials provided to you, which are supplemented by these Terms. These Terms also apply to the following promotion:
Free energy for your first month. Following your enrollment in an eligible service offered by Inspire pursuant to the Electricity Supply Agreement and subject to the terms and conditions set forth herein, your first full month of electricity supply charges for the residence approved by Inspire will be reimbursed to you within 60 days following the end of the billing cycle of your first full month of service with Inspire, so long as you comply with and are in compliance with the Electricity Sales Agreement and these Terms. This Promotion is subject to the terms of these Terms and the following terms and conditions:
- The Promotion is only available for customers in areas where Inspire can provide electricity supply services under Inspire’s Electricity Sales Agreement (i.e., you are ineligible for the Promotion if Inspire determines you are ineligible to enroll in electricity supply services with Inspire)
- You must be a new customer of Inspire (if you are already enrolled in or have previously subscribed to any Inspire service, you are ineligible for this Promotion)
- You must complete at least one (1) month of full month electricity supply service with Inspire (at least 25 calendar days), pursuant to the Electricity Sales Agreement and any cancellations or recissions prior to this voids the Promotion and your eligibility
- You have enrolled in an Inspire subscription or fixed-rate plan for electricity supply services
- This Promotion is not available for non-residential or commercial customers; and
- The first month value to be reimbursed will not exceed $500 (for the avoidance of doubt, Inspire will not be obligated to honor any reimbursement or payment in connection with this Promotion in excess of $500).
Reimbursements under this Promotion will be made by any means Inspire deems appropriate, including by check (to be mailed to your address Inspire has on record). You are responsible for paying any delivery, distribution, or other charges billed by your utility company, and Inspire is not responsible for any damages or losses related to your failure to pay any utility company charges. Upon our request, you agree to provide a copy of your bill or invoice or any other information Inspire may request; Inspire is not obligated to provide any reimbursement or honor this promotion if you fail to provide it with any information it may request or if it believes you are fraudulently enrolling in the services under the Electricity Sales Agreement or this Promotion or you are otherwise engaging in any fraudulent, gaming, or abusive conduct (as Inspire may determine in its sole discretion).
When Inspire offers you a Promotion, it reserves the right to determine eligibility for the Promotion. In addition, Inspire may disclose additional limitations related to a Promotion when you sign- up for a Promotion or in other materials provided or made available to you. Inspire reserves the right, in its sole discretion, to determine whether a particular Customer has met all requirements to be eligible for a particular Promotion. If your Inspire account is cancelled, closed, or otherwise terminated for any reason, including termination of the account by Inspire prior to meeting all requirements to earn a Promotion, your claim to any Promotion is forfeited.
Promotions may not be applied as a credit or offset to reduce the amount owed by a Customer to Inspire or the Customer’s local utility company. To the extent the Promotion is not a cash award, the Promotions shall have no cash value or other value of any kind until the relevant accrual period is complete and the Promotions are redeemed by the Customer. The Customer shall have no property rights or other legal interest in the Promotion until redeemed and received by Customer. The Customer may not assign, transfer or pledge Promotions. Promotions cannot be transferred or combined with other offers or Promotions. Promotions may change or be cancelled at any time. Promotions are not available for all rate classes, all customer types, or in all areas. You are not eligible for any Promotion relating to initial enrollment with Inspire (e.g. a “Sign Up Bonus”) if you have ever previously been enrolled with Inspire. Promotions are limited to one per customer and electricity account. Each Promotion is non-transferrable and may not be resold. If you violate these Terms or the terms of Electricity Sales Agreement, the Promotion will be invalid and Inspire will be excused from performance under these Terms. Promotions are limited time offers. Promotions are not available in areas where Inspire does not offer its services.
4. Customer Information
5. Inspire Smart Thermostat (if applicable)
In the event Inspire provides you with an Inspire smart thermostat in connection with your enrollment in services provided under the Electricity Sales Agreement, this Section 5 applies. To the fullest extent permissible under applicable law, you are solely responsible for securing any consents, authorizations, or other permissions of any kind that may be reasonably required in order to install and use the Inspire smart thermostat at the premises in which you desire to install and use such the Inspire smart thermostat. Without limiting the generality of the foregoing, and for purposes of clarity, to the fullest extent permissible under applicable law, you agree that Inspire is not liable to you or anyone else if your installation and use of the Inspire Smart Thermostat at the premises in which you have installed and/or used such thermostat does or may violate in any manner the rights of any third-party (such as, by way of example and without limitation, the owner of the premises or any other tenant) or your agreements with any third-party (such as, by way of example and without limitation, your rental or lease agreement). Inspire recommends that you keep the thermostat that will be replaced by the Inspire smart thermostat. Should you move, Inspire is not obligated to re-install the Inspire smart thermostat at your new location.
Any tax liability relating to Promotions is the sole responsibility of the Customer. Inspire shall not be responsible for resolving any conflicting claims to any Promotions. In the event that all or part of any Promotion is found to be in violation of applicable law, Inspire shall have no obligation to provide any Promotion to Customer found to be in violation of that applicable law.
Promotions are void where prohibited by law. You understand that Inspire may revoke your participation in any Promotion at any time, and, any Promotion associated with you that may have accumulated or you may be entitled to may be forfeited at Inspire’s discretion.
Inspire may end any Promotion at any time for any reason or no reason, without notice unless notice is required under law. Inspire may also in our sole discretion cancel, change, amend, modify, or restrict the Promotion or any aspects, terms or features of the Promotion or these Terms at any time without prior notice for any reason or no reason (subject to any notice requirements under applicable law). You consent to all such changes and that they will apply to you and the Promotions. All interpretations of these Terms will be determined by Inspire in its sole discretion.
Inspire may temporarily or permanently disqualify you from participating in any Promotion and/or adjust or cause to be forfeited any or all Promotion rights accrued as a result of your abusive behavior, fraud, misrepresentation, any violation of law or any other violation of any of the terms or conditions of these Terms or the Electricity Sales Agreement, in each case as determined by Inspire in its sole discretion.
A Promotion cannot be combined with other Promotions, Rewards (as defined under the Rewards Terms and Conditions), other discount or reward programs, unless specifically authorized by Inspire.
You agree to indemnify and hold Inspire and its third-party service providers and their respective affiliates, directors, officers, employees, agents and contractors harmless from and against any loss, damage, liability, cost, or expense of any kind (including attorneys’ fees) arising from your or: (i) participation in a Promotion; (ii) any fraud or misuse of a Promotion; (iii) violation of these Terms; and/or (iv) violation of any applicable law or the rights of any third party.
These terms and conditions governing Promotions may be modified by Inspire in its sole discretion, provided that Inspire provides any notice to the Customer as required by applicable law.
